CUSTOMER CONTENT
Customers retain ownership of their content.
By utilizing hosting services, customers grant Incend Media a limited right to access, store, transfer, backup, and manage content solely as necessary to provide hosting, support, maintenance, security, monitoring, migration, and recovery services.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Incend Media shall not be liable for:
• Lost revenue
• Lost profits
• Lost data
• Business interruption
• Lost opportunities
• Security incidents
• Service interruptions
• Hardware failures
• Software failures
• Third-party provider failures
Incend Media’s total liability arising from hosting services shall not exceed the amount paid by the customer for hosting services during the three (3) months immediately preceding the event giving rise to the claim.
REFUNDS
Unless otherwise specified in a separate written agreement, hosting services are non-refundable once provisioned.
Incend Media may, at its sole discretion, issue credits, partial refunds, or service adjustments when appropriate.
GOVERNING LAW
These terms shall be governed by and interpreted under the laws of the State of Missouri, without regard to conflict of law principles.
Any disputes arising from hosting services shall be resolved in the appropriate state or federal courts located within Missouri unless otherwise agreed in writing.
CHANGES TO THESE TERMS
Incend Media reserves the right to modify these Hosting Terms at any time.
Updated versions will be posted with a revised effective date. Continued use of hosting services constitutes acceptance of any revisions.

DOMAIN NAME REGISTRATION POLICIES
Domain name registrations are governed by the terms, conditions, and registration agreements of the applicable domain registrar and the Internet Corporation for Assigned Names and Numbers (ICANN).
